If a landlord gives no notice of refusal or changed terms between six and two months before the lease ends, and the tenant too stays silent until two months before expiry, the lease automatically extends on the same terms. This is implied renewal (muksijeok gaengsin), and the extended term counts as two years. Two things matter most — the rent stays the same, and the tenant can still leave anytime within those two years, with the lease ending three months after giving notice.

When Does Implied Renewal Take Effect — the Notice Window

The key is that no one speaks up during the 'notice window.' The landlord must give notice of refusal or changed terms between six and two months before expiry, and the tenant must signal any intent to leave by two months before. If both sides let that window pass, the lease rolls on automatically. Note that for leases signed before 10 December 2020, the tenant's notice deadline is different — one month before expiry.

One caveat: if the tenant has fallen two or more months behind on rent or breached the contract, implied renewal is not recognized. The door to automatic extension opens only for a tenant in good standing.

Implied Renewal vs Renewal Right vs Negotiated Renewal

Lease renewal in Korea comes in three forms: implied renewal that rolls on because no one spoke, the renewal-request right the tenant asserts as a right, and a negotiated renewal where both sides agree new terms. Set side by side, the differences are clear.

Implied renewal does not count against the renewal-request right — after quietly auto-extending for two years, a tenant can still play the renewal-request card once later.

This distinction matters in practice. Rather than forcing the tenant to spend the renewal right against a 5% rent hike, quietly letting the lease pass into implied renewal saves the tenant 'a card' for later. Leaving Mid-Term — the Three-Month Rule

Even after a two-year implied renewal, the tenant may give notice to terminate at any point. But it takes effect three months after the landlord receives notice. Give notice to leave on 1 August, and the lease ends 1 November, when the landlord's duty to return the deposit arises. Move out without giving notice, however, and the lease lives on — rent can keep accruing.

This three-month rule applies equally to a lease renewed via the renewal-request right. A negotiated renewal, by contrast, generally has no such early-exit right, so 'how the lease was renewed' governs your freedom to leave. To get the deposit back safely, it also helps to confirm before moving that the opposability secured through a fixed date and move-in registration is still intact.

What to Check

  • Confirm whether your lease predates 10 December 2020 — it changes whether your notice deadline is one or two months before expiry.
  • To let it auto-renew, both sides simply stay silent through the notice window (6–2 months before); to change terms, you must give notice within it.
  • A history of being two or more months behind on rent can void implied renewal, so clear up any arrears record.
  • Early termination is 'effective three months after notice' — count back from your move date and give written notice (text, certified mail) at least three months ahead.
  • Remember implied renewal does not consume the renewal-request right; keep that card for the next negotiation.
